Terms of Service

Important notice

These Terms contain a binding arbitration clause and a class-action waiver (Section 14). By using Unseen Roll you agree to resolve disputes individually through arbitration.

1. Who we are

Unseen Roll ("Unseen Roll", "we", "us") is operated by Necati Atahan, an individual doing business as Unseen Roll (the "Operator"). Unseen Roll is not a corporation or limited liability company at this time. We operate unseenroll.com, a disposable-camera platform for events: guests capture photos on their phones, the photos stay hidden while the roll is open, and the gallery unlocks at a reveal time chosen by the event host. 3. Eligibility

You must be at least 18 years old to create an account or join an event. Every participant confirms this at the consent screen before capturing. We do not knowingly provide the service to anyone under 18. Photos taken at events may incidentally include other people, including minors; the Host is responsible for ensuring photography is appropriate and permitted at their event (Section 8).

4. Accounts and sign-in

Consumer accounts sign in with Apple or Google. Enterprise guests may join by phone number with a one-time code. You are responsible for activity under your session; tell us at [email protected] if you believe your account is compromised.

5. The disposable mechanic

The product intentionally restricts what you can do, like film: depending on the host's settings there is no preview, no retake, and no self-delete. By capturing you accept that:

Separately from Host curation, Unseen Roll retains the right to remove, hide, quarantine, restrict, or disable any content or event where we reasonably believe it is necessary for legal compliance, privacy, safety, child protection, intellectual-property protection, security, abuse prevention, or platform integrity — regardless of Host settings or decisions. Privacy, safety, and legal removal requests may be sent to [email protected] at any time.

These points are also presented, one by one, at the consent screen you accept before capturing. The consent version you accepted is stored with your participation.

6. Payments, refunds, reschedules

Event packages and add-ons are sold through Stripe. Where Stripe Managed Payments applies, Stripe is the merchant of record for your purchase and its consumer terms apply to billing, sales tax, and disputes. Prices are shown before purchase; the free tier is limited as described on the pricing page. There are no subscriptions and no automatic recurring charges.

Refunds for cancelled events follow the published tiers (75% / 50% / 25% / 0% of the package price by how far ahead of the original event date you cancel). Once an event is live, it is non-refundable. Rescheduling is free and unlimited within one year of the original date, but the first reschedule permanently waives the refund option. Add-ons (bulk download, retention extensions) are non-refundable once delivered. Test Rolls are free and carry no refund. Service failures on our side are handled case by case and may result in a credit, refund, or other reasonable remedy.

7. Content ownership and license

You own your photos. Uploading a photo to Unseen Roll does not transfer copyright ownership to us or to anyone else. The photographer retains all copyright they hold in their photos.

Operational license to Unseen Roll. So that we can run the service, you grant Unseen Roll a worldwide, non-exclusive, royalty-free, fully paid license to host, store, back up, copy, cache, transmit, and process your User Content; to technically transform it (including resizing, compression, re-formatting, and the creation of processed variants and aesthetic renditions as part of develop and reveal); to scan it with automated moderation and security tooling (including hash-matching for known child sexual abuse material and nudity screening); to display it to the event's authorized participants under the event's rules; to deliver it, including downloads and bundles; and to use it as reasonably necessary for customer support, service operation and improvement, fraud and security investigation, and legal compliance. This license includes the right to sublicense to the infrastructure and service providers we use to operate the service, and is transferable in connection with an assignment under Section 15. It is perpetual and irrevocable only to the extent necessary for uses already made and deliveries already completed while it was in force (for example, copies other participants lawfully downloaded); otherwise it ends when your content is deleted under Section 11.

What this license does not include. We do not acquire ownership; we do not use your photos to train AI models; and we do not use your photos for advertising or marketing without a separate, explicit, recorded opt-in (no such opt-in exists in the product today).

Rights are layered. Copyright ownership (the photographer's), Unseen Roll's operational license (above), the Host's rights to view, download, curate, and share the Collection as the product allows, any Enterprise Customer's contractual rights under a separately signed written agreement, and the privacy and publicity rights of the people who appear in photographs are distinct. None of them absorbs the others, and nothing in these Terms transfers copyright ownership or waives a depicted person's rights under applicable law.

8. Host responsibilities

Hosts are responsible for: having the right to run photography at their venue; informing guests that photography is happening; handling guest delete requests in good faith; the composition of any public exposure they enable (portfolio, public links where available); and, for Enterprise, lawful use of SMS invitations (Section 10).

9. Prohibited content and child safety

Our Acceptable Use Policy (https://unseenroll.com/legal/acceptable-use) applies to everything captured or uploaded. We use automated tooling on uploaded images, including hash-matching for known child sexual abuse material (CSAM) and machine-based nudity screening. Automated flags may hide a photo pending review; a flag is a signal for review, not a determination. Unseen Roll will make reports to NCMEC's CyberTipline when required by applicable law, will preserve related material as the law requires, and will cooperate with lawful requests and applicable child-safety obligations.

10. SMS (Enterprise events)

Enterprise guests may receive SMS invitations and one-time codes. Our SMS Terms (https://unseenroll.com/legal/sms) apply. Messages are sent only to numbers the event's organizer provided or that opted in; reply STOP to stop receiving messages. Message and data rates may apply. Hosts warrant that they have the necessary consent to submit guest phone numbers.

11. Retention and deletion

Galleries stay online for the retention period of the purchased tier (published on the pricing page), extendable for a fee. Seven days after the reveal the roll freezes. Thirty days after retention ends, photos are permanently deleted from storage, except where the law requires us to preserve specific material. We may retain transactional records (payments, consent logs, audit entries) as required by law.

12. Service changes, suspension, termination

We may modify or discontinue features with reasonable notice for paid functionality. We may suspend accounts or events that violate these Terms or the AUP, or where required by law. You may stop using the service at any time; Section 6 governs refunds.

13. Disclaimers and limitation of liability

The service is provided "as is". We use commercially reasonable measures to provide and protect the service but do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, our aggregate liability for any claim is limited to the greater of $100 or the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental, special, or consequential damages, lost profits, lost revenue, or loss of goodwill, or for lost photos beyond the storage commitments in Section 11 — capture conditions (device, connectivity) are outside our control. Some jurisdictions do not allow certain limitations; where a limitation is not permitted, it applies to the maximum extent permitted.

14. Dispute resolution; arbitration; class waiver

Before filing a claim, contact [email protected] and give us 30 days to resolve it informally. Unresolved disputes are settled by binding individual arbitration under the AAA Consumer Arbitration Rules in San Diego County, California; hearings may be conducted remotely at either party's request, and filing, administration, and arbitrator fees are allocated as the AAA Consumer Rules provide. You and we each waive jury trial and class actions; if the class-action waiver is found unenforceable as to a claim, that claim must proceed in court, not in arbitration. Small-claims court and injunctive relief for intellectual-property misuse are excepted. You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected]. This section survives termination.

15. General

These Terms are governed by California law. If a provision is unenforceable, the rest remains in effect. We may assign these Terms and our rights and obligations, including to a successor entity that assumes operation of the service; your rights under these Terms are not reduced by such an assignment. We may update these Terms; material changes are versioned, dated, and re-consented where required. The current version is always at https://unseenroll.com/legal/terms.
